DESCRIPTION: The Elevate Your Home Sweepstakes (the “Sweepstakes”) is sponsored by Legacy Restoration, LLC (the “Sponsor”). The Sweepstakes begins on February 1, 2024 at 12:01 A.M. and ends on December 31, 2024 at 11:59 P.M. (the “Sweepstakes Period”). Entries submitted before or after the Sweepstakes Period will be disqualified.
ACCEPTANCE OF OFFICIAL RULES: Each person by virtue of their participation in the Sweepstakes (“Entrants”) unconditionally accepts and agrees to comply with and abide by these Official Rules, and the decisions of the Sponsor, which are final and binding. Winning the Grand Prize (as hereinafter defined) is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.
ELIGIBILITY: Entrants must be a legal resident of Minneapolis, Minnesota, St. Paul, Minnesota, Rochester, Minnesota, St. Cloud, Minnesota, or Chicago, Illinois (“Eligible Cities”) and must own a single-family home that is located within a 30-mile radius of a Legacy Restoration, LLC regional office in the state of Minnesota or Illinois. Entrants must be eighteen (18) years or older to enter. Entries submitted by Entrants that do not meet these eligibility requirements will be void.
HOW TO ENTER:
VIA ENTRY CARD: This method of entry will be available at all the Sponsor’s home shows or events located in the Eligible Cities. To enter using this method, Entrants must complete an entry card provided by the Sponsor and provide their full name, address, phone number, email address and date of birth. VIA ONLINE ENTRY: This method of entry will be available on the Sponsor’s official website. To enter using this method, Entrants must visit legacyrestorationllc.com/sweepstakes and follow the online instructions to submit their full name, address, phone number, email address and date of birth. VIA SOCIAL MEDIA: This method of entry will be available on the Sponsor’s social media platforms. To enter using this method, Entrants must visit the Sponsor’s social media account, like and share the Sponsor’s post regarding the Sweepstakes, and use the link included in the post to navigate to the Sponsor’s website where they must follow the online instructions to submit their full name, address, phone number, email address and date of birth.
Entries are limited to one per person and one per household for the duration of the Sweepstakes Period, regardless of method of entry. Entrants who submit more than the permitted entries will have all entries disqualified.
WINNER SELECTION AND NOTIFICATION: On or about January 31, 2025, the Sponsor will select one winner (the “Winner”) in a random drawing from among all eligible entries received. The odds of being selected depend on the number of entries received. The Sponsor will notify the Winner by email or phone call at the email address or phone number provided in the Winner’s entry no later than February 15, 2025 (the “Notice”). The Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), inactive phone number(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account.
The Winner must sign a written acceptance of the prize (“Written Acceptance”) and an affidavit of eligibility (“Affidavit”) within ten (10) days of the date the Notice is sent. The Winner’s failure to send the Written Acceptance or the Affidavit may result in the forfeiture of the Grand Prize (as hereinafter defined). The Winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.
GRAND PRIZE: The Winner will receive a comprehensive home exterior inspection and may select one of the following three options, to be professionally installed by the Sponsor’s skilled technicians. The Grand Prize has a retail value of approximately $30,000.00 Odds of receiving the Grand Prize depends on the number of entries received:
- A new roof;
- New siding; or
- New windows
(the “Grand Prize”). The Winner shall include its selection in its Written Acceptance. Material specifications to be determined by Sponsor. The Winner must apply the Grand Prize to a home owned by Winner in an Eligible City and located within a 30-mile radius of a Legacy Restoration, LLC regional office. The Grand Prize is not transferrable and cannot be redeemed for cash.The Sponsor, within thirty (30) days from the date the Notice was sent, will provide the Winner with a certificate granting the Winner the Grand Prize. The Sponsor will perform the inspection and commence efforts to install the Grand Prize on a date agreed upon by the Sponsor and the Winner.
RESTRICTIONS:
A RESTRICTION APPLIES: Before receiving the Grand Prize, Winner must first execute an installation contract with Sponsor containing the terms and conditions of the installation and any statutory requirements for home improvements performed within the Winner’s state (the “Installation Contract”). Failure to execute the Installation Contract will prevent the Winner from receipt of the Grand Prize.
A RESTRICTION APPLIES: The Grand Prize cannot be claimed if the Winner’s roof, windows, or siding replacement are covered by insurance.
GENERAL CONDITIONS: The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be in violation of a criminal and civil law, and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, Entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Grand Prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, postage-due or misdirected mail, entries, any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, or in any Sweepstakes-related materials; or injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the Grand Prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to actual damages, and in no event shall the entrant be entitled to receive consequential damages or attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
DISPUTES: Except where prohibited, each Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration administered by the American Arbitration Association. This Agreement to arbitrate shall be specifically enforceable under the prevailing arbitration law. The award rendered by the arbitrators shall be final, and judgment may be entered upon it in any Court having jurisdiction thereof. . All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Minnesota.
